There's no more important function of the press than government watchdog. Whether it's to protect or curry favor with official sources, to preserve access, or just a jones for authority and the cult of expertise, the legacy media too often comes off as government's biggest fan. And it's a problem that transcends left-right ideology.

These outsize earnings are symptomatic of a disease that is slowly killing the American economy. We are creating so much regulation – over tax policy, health care, financial activity – that smart people have figured out that they can get rich faster and more easily by manipulating rules on behalf of existing corporations than by creating net new activity and wealth. Gamesmanship pays better than entrepreneurship.

On Thursday, the Senate Judiciary Committee unanimously approved a bill that would give the Attorney General the right to shut down websites with a court order if copyright infringement is deemed "central to the activity" of the site — regardless if the website has actually committed a crime. The Combating Online Infringement and Counterfeits Act (COICA) is among the most draconian laws ever considered to combat digital piracy, and contains what some have called the "nuclear option," which would essentially allow the Attorney General to turn suspected websites "off."

It would be hard to assemble a bigger bunch of rent-seekers hoping to cash in on complicated new climate change regulations. For example, USCAP favored the incredibly recondite (but lucrative) Waxman-Markey cap-and-trade bill passed by the House of Representatives in 2009. In that bill, USCAP companies would be showered with free carbon emissions permits which they could turn into free cash.
